What is a Contested Divorce?
A contested divorce is when all parties disagree on some or all of the issues regarding the divorce. However, there may be some agreed-upon aspects, and some still need to be agreed upon.
Contested Divorce Process
The process begins when one party or spouse serves a Petition and Summons on the other party. These documents will notify the other spouse of the process and outline what they are asking. After the documents are served, a thirty-day response period will begin for the spouse receiving the documents. Next, the discovery process will commence, which allows people to request information about income and assets, custody, and parenting issues.
If there is no agreement, the court will likely order parents to attend mediation. Mediation is a form of alternative dispute resolution.
If there is no agreement between parties, they may want to seek mediation. A third party, known as a mediator, would need to be involved. The third party would assist in facilitating an agreement and providing a framework without taking over the decision-making process.
